Terms of Service

These terms govern your use of Digigift (the “Service”), operated by [Legal entity name], [Registered address]. By creating a gift or paying on the Service you agree to them.

1. What the Service does

The Service lets you create a personalised digital gift consisting of a message and photos, preview it, and — after a one-time payment — publish it at a private link that you can share with anyone. Recipients do not need an account.

2. Your account and drafts

You can build and preview a gift without an account. We ask for your email at checkout so we can send your receipt and let you sign in later to manage your gifts. Keep your sign-in emails private; anyone with access to your email can access your gifts.

3. Pricing and payment

A gift costs ₹99, $2.99, €2.99, £2.49, AED 10.99, $3.99, $4.49 depending on the currency you choose at checkout, charged once. Prices include any taxes we are required to collect unless the checkout says otherwise. Payments are processed by Razorpay (India, INR) and Stripe (other currencies); we never see or store your card, UPI or bank details. A gift is published only after our server has received confirmation of your payment from the payment provider.

3A. Taxes and consumer rights

Prices include any VAT, GST or sales tax we are required to charge; the checkout shows the amount you will pay. Nothing in these terms limits statutory consumer rights that apply where you live.

4. Your content

You own the content you upload. You grant us a limited licence to store, process (for example, resize and re-encode photos) and display it solely to operate the Service for you and the people you share the link with. You confirm you have the right to use everything you upload, including the right to include any person’s photo or name.

4A. AI suggestions

Optional AI tools generate suggestions from what you provide. They can be wrong or generic, so read and edit everything before you publish. You remain responsible for your gift’s content, and the acceptable-use rules apply to AI-assisted text exactly as to text you write yourself.

5. Acceptable use

You must follow our Acceptable Use Policy. We may remove a gift, without refund where you have breached it, and suspend access for serious or repeated breaches.

6. Links and privacy of gifts

Gift links are long random addresses that are not listed publicly and are excluded from search engines. Anyone who has the link can open the gift, so share it only with the people you intend. You can delete a gift at any time from your dashboard.

7. Refunds

Refunds are handled under our Refund Policy.

8. Availability

We aim to keep the Service available and your gift links working, but we do not guarantee uninterrupted service. We may change or discontinue features, and will give reasonable notice before removing gifts you have paid for.

9. Liability

To the extent permitted by law, the Service is provided “as is” and our total liability to you for any claim is limited to the amount you paid for the gift concerned. Nothing in these terms limits liability that cannot be limited by law.

10. Governing law

These terms are governed by the laws of India. Courts at [your city] have jurisdiction, subject to any rights you have under mandatory consumer law.
